Đặt commission tức khách đã đồng ý với những điều khoản dịch vụ dưới đây

Commission chỉ sử dụng với mục đích cá nhân, phi thương mại, phi lợi nhuận.
Commission với mục đích thương mại sẽ có thêm phí tùy theo thỏa thuận.

Mình có quyền đăng thành phẩm commission trên các nền tảng mạng xã hội, portfolio, làm sample v.v.
Nếu khách không muốn đăng công khai sẽ tính thêm phí 50%.

Credit mình khi đăng hay sử dụng commission

Mình được phép từ chối tiếp nhận commission nếu cảm thấy yêu cầu không phù hợp với mình.

Khách cần cung cấp đầy đủ hình ảnh reference cần thiết. Không chấp nhận vẽ theo thiết kế nhân vật được miêu tả bằng chữ.
Khách cần đảm bảo có quyền sử dụng các thiết kế liên quan đến nhân vật đã cung cấp.

Không chấp nhận hình ảnh reference tạo ra bởi / đã qua xử lý qua AI.
Không chấp nhận việc dùng AI xử lý các tác phẩm của mình (cả commission hoàn thiện lẫn WIP).
Không chấp nhận việc biến tác phẩm của mình thành NFT.
Không chỉnh sửa hay làm biến dạng commission đã hoàn thành.

QUY TRÌNH

Tùy theo loại commission mà quy trình sẽ thay đổi.
VD: Commission gacha hay sketch sẽ không có đủ các bước dưới.

Các bước trong quy trình đầy đủ thông thường: Sketch -> thumbnail màu -> line -> render

Sau mỗi bước mình sẽ gửi khách WIP để duyệt
Mỗi bước khách được yêu cầu sửa 3 lần
Sau khi render xong tranh mình chỉ đồng ý sửa những chi tiết nhỏ

Sau khi tranh đã hoàn thiện: Mình sẽ gửi khách file hoàn thành full, không watermark qua email

Mình giữ quyền sử dụng những option WIP không được chọn.
Không được copy, trace từ WIP.

Deadline: tùy thuộc loại commission.
Khách có thể đặt deadline. Nếu deadline gấp sẽ tính thêm phí.

THANH TOÁN

Hình thức: Chuyển khoản ngân hàng, Momo, Paypal

Sau khi mình báo giá: Thanh toán ít nhất 40% giá trị commission trong 48h.
Mình sẽ bắt đầu làm việc sau khi nhận thanh toán.
Lưu ý: Số tiền 40% này sẽ không được hoàn lại.

Sau khi duyệt sketch: Thanh toán phần còn lại giá trị commission trong 48h.

Sau thời hạn mà không thanh toán sẽ được coi là khách đã hủy commission.

HOÀN TIỀN

Trong trường hợp khách hủy commission khi:
Đã thanh toán báo giá: Hoàn tiền tối đa 60% giá trị commission
Đã hoàn thiện sketch: Hoàn tiền tối đa 50% giá trị commission
Đã hoàn thiện thumbnail màu: Hoàn tiền tối đa 40% giá trị commission
Đã hoàn thiện line: Không hoàn tiền
(Áp dụng tùy loại commission)

Trong trường hợp mình huỷ commission:
Nếu phần commission đã duyệt đến thời điểm này được khách chấp nhận, mình sẽ hoàn tiền tùy theo khối lượng công việc đã hoàn thành.
Nếu không, khách sẽ được hoàn tiền những khoản đã thanh toán.

Trong trường hợp khách vi phạm Điều khoản dịch vụ: hủy commission và không hoàn tiền

Khách cam kết sẽ không chargeback. Nếu khách chargeback:
Hủy commission
Cho phép mình bán hoặc sử dụng lại commission theo ý muốn
Khách sẽ vào blacklist công khai với bằng chứng

Commissioning me means you have agreed to the Terms of Service

Commissions are for personal, non-commercial, non-profit use only.
Commercial works will have additional fees based on negotiations

I have the right to post finished commission artworks on social networking platforms, portfolios, use as samples, etc.
There will be an additional 50% fee if the client wants the commission to remain private.

Credit is required when display or use the commission

I have the right to decline commission requests and projects.

Provide all the necessary reference images. Text descriptions of character designs are not accepted.
Clients must ensure they have the rights to use designs provided.

Reference images created by or processed by AI are not accepted.
The procession of my artworks (finished or WIP) through AI / usage as NFTs are prohibited.
Finished commissions are not to be edited or distorted

PROCESS

The process is determined by the type of commission.
E.g. Sketch commission and surprise me commissions won’t follow the following steps

A full process includes: Sketch -> color thumbnail -> line -> render

I will send the WIP after each step
For each step the client is allowed 3 revisions
After completing the painting, I will only correct small details

I will send the fully completed file without watermark via email
I reserve the rights for unchosen WIPs. WIPs are not to be copied or traced.

Deadline: determined by the type of commission.
Client can set the deadline. An additional fee will be charged if the deadline is urgent.

PAYMENT

Payment methods include: Local bank transfer, Momo, Paypal

After the price quote is given: At least 40% of the agreed upon full price must be paid within 48hrs.
I will begin working once this first payment is received
Note: This 40% won’t be refunded

After the sketch is completed: The rest of the final price must be paid within 48hrs.

Past the deadline, the commission will be considered cancelled

REFUND

If the client cancel the commission:
After the first payment: A maximum of 60% of the price is refundable
After the completion of the sketch: A maximum of 50% of the price is refundable
After the completion of the color thumbnail: A maximum of 40% of the price is refundable
After the completion of the line work: No refunds
(Applicable depending on the type of commission)

If I cancel the commission:
If work done up to this point is accepted by the client, I will provide a partial refund according to the amount of work completed
Otherwise the client will receive a full refund for any payments already made

If the client violate the Terms of Service: the commission will be cancelled and no refunds will be given.

The client agrees not to make a chargeback. If a chargeback is issued:
The commission will be cancelled
The client’s rights to the commission is forfeited, allow me to resell or reuse the artwork to my need
The client will be placed in a public blacklist with evidence
